Building in Betterton.

Betterton is perched on the Chesapeake Bay bluffs where the Sassafras River meets the Bay. It was a resort in the steamboat era, and its public beach, boardwalk and bathhouse are owned by Kent County. The Betterton Historic District, about 300 acres of the town center bounded by the Sassafras River, Sixth Avenue and Howell Point Road, joined the National Register in 1984, and the Betterton Heritage Museum is in town.

With 286 residents in the 2020 Census it is small, but Betterton runs its own building, use and occupancy permits. We prepare the plot plans and building sets the town asks for, follow the routing to each reviewer and build once the Town Manager and inspector sign off, making the 67-minute, 38-mile trip from our Dover office.

Permits and rules in Betterton.

Submit the permit application to the clerk at the Town of Betterton, Town Office, 100 Main Street, (410) 348-5522, with three plot plans and three sets of building plans. The clerk routes it to the zoning administrator, the Planning Commission, Critical Area staff and the inspection agency. No construction starts until the Town Manager and the Middle Department Inspection Agency building inspector approve, and fees are paid after approval. A project that changes the house’s footprint also needs Planning and Zoning Commission approval.

MDIA does the footer, foundation, framing, insulation and final inspections. For a new dwelling, more than 5,000 sq ft of disturbance or work in the Critical Area Buffer, the erosion and sediment control and stormwater plans go through the Kent County Planning Office. The town’s bulletin dates to 2014 and its fee schedule to 2018, so we confirm current steps and fees with the Town Office. Under that schedule, prefab sheds under 200 sq ft need no permit but must meet setbacks.

What people build around Betterton.

For a post-frame garage or storage building in Betterton, depth matters as much as size: the town’s plan rules call for footings at least 32 inches below finished grade, so we plan post holes and footings to that depth from the start. A detached accessory building can take up no more than 30% of the required rear yard and must stay 5 feet from the rear line and 3 feet from a side line. It can go up only if the house already exists or is under construction.

Does the National Register district limit what I can build in Betterton?

The Betterton Historic District is on the National Register, and the town notes that listing alone doesn’t stop owners from making changes. No separate town historic commission is listed, though zoning, Critical Area and Planning Commission review still apply to a new building.

What about the Critical Area in Betterton?

Betterton’s zoning ordinance maps Intensely Developed, Limited Development and Resource Conservation land in town. In the LDA and RCA, impervious surface is limited to 15% of the lot, with a sliding scale for lots that existed by December 1, 1985, and permits there need the town’s Critical Area worksheet.
