Building in Talbot County.

Talbot County runs from farm villages like Cordova and the Wye Mills crossroads to waterfront towns on the Miles and Tred Avon rivers and out to Tilghman Island on the Bay. Easton is the county seat, and 37,526 people lived in the county in 2020. Inland, a village like Cordova is mostly farm and forest land, and within 1,000 feet of tidal water the Critical Area rules come into every project, from a shed to a barndominium.

Easton is about 48 miles and 73 minutes from our Dover office, Cordova about 59 minutes and Tilghman Island about 113. We draw the building and an organized quote, handle the county or town permits, and our crews build it, with a project manager keeping you posted. Final payment comes after the final inspection, and every job carries our 5-year workmanship warranty.

Pole barn permits in Talbot County.

Outside Easton, St. Michaels, Trappe, Oxford and Queen Anne, permits come from the Talbot County Department of Permits and Inspections, 215 Bay Street, Suite 3, Easton, 410-770-6840, open weekdays 8:00 a.m. to 4:30 p.m. Applications are filed on the county’s OpenGov portal, and uploaded plans must also be delivered in hard copy. Zoning, Critical Area and floodplain review sit with the separate Department of Planning and Zoning in Suite 2, 410-770-8030. Before a permit issues, the building official collects sign-offs from Planning and Zoning, the State Fire Marshal, Environmental Health, Soil Conservation, Public Works and MDE.

A detached garage, carport or other non-farm building goes through the Building Permit with Trades, a full building permit, while a one-story storage shed of 300 sq ft or less needs only a zoning certificate through the Shed Permit. An accessory building generally needs a house or principal use on the lot first; otherwise it takes a Board of Appeals special exception or, while the house is being built, a temporary-use certificate. Work must start within 9 months and finish within 18, with up to two 120-day extensions. The county’s code supplement lists a 30 psf ground snow load and a 24-inch frost depth.

Farm buildings are exempt from the county building permit but need a zoning certificate before construction, and they remain subject to IBC Appendix C for agricultural buildings. The county’s Agricultural Structure Permit covers buildings that are strictly agricultural; one mixed with a home or a business takes the regular permit. The county’s guide calls for a stakeout inspection before the certificate issues and a final inspection at the end. Stables and dairy barns need 100 feet from property lines, poultry and hog houses and manure structures 200 feet, and farm buildings can reach 40 feet. Farm buildings over 6,000 sq ft within 500 feet of a town boundary need site plan approval.

Talbot’s Critical Area program dates to August 13, 1989. In the Resource Conservation and Limited Development areas, lot coverage is capped at 15%, and no new structures, sheds and garages included, go in the Shoreline Development Buffer, which runs at least 100 feet from tidal water and widens on steep slopes and sensitive soils. A building outside the Buffer on a lot that includes it triggers Buffer planting equal to the added coverage. In a flood zone, new buildings sit at least 2 feet above base flood elevation or at 7.0 feet NAVD, whichever is higher, and a garage of 300 sq ft or more left below base flood needs a variance and a recorded nonconversion agreement.

Farming in Talbot County.

Talbot County had 357 farms in the 2022 Census of Agriculture, up 13% from 2017, on 96,228 acres, an average of 270 acres each. Crops made up 62% of the county’s $109.7 million in farm sales. Grains, oilseeds and dry beans brought $63.4 million, sixth in Maryland, and poultry and eggs $36.4 million, with 1,179,400 broilers counted at the end of 2022. Soybeans covered 39,627 acres, corn for grain 28,914 and wheat 14,038, and 5,674 acres were irrigated. Grain farms run on equipment, so machinery storage and implement sheds fit the work here.

Towns we build in across Talbot County.

Easton, St. Michaels, Trappe, Oxford and Queen Anne sit outside the county permit office’s jurisdiction and run their own processes. Easton splits zoning and building into two steps at 14 S. Harrison Street, St. Michaels sends plan review and inspections to Middle Department Inspection Agency, Oxford runs a multi-step review, and Trappe uses one application for both. Queen Anne straddles the Talbot and Queen Anne’s line and hasn’t published a process; the state lists its Mayor as the building-code contact, 410-364-9229. Cordova, Tilghman Island and the Talbot side of Wye Mills are unincorporated and go through the county.

Still wondering about something? Call us at 302-399-4420.

Do farm buildings need a permit in Talbot County?

They don’t need a building permit, but they do need a zoning certificate through the county’s Agricultural Structure Permit, which follows a stakeout inspection and ends with a final inspection. That route is only for buildings used strictly for agriculture, and county impact fees don’t apply to farm structures.

Can I build a garage before the house in Talbot County?

Generally not. An accessory building needs an existing principal use or structure on the lot, or foundation work on the house already under way. Otherwise an accessory storage building needs a Board of Appeals special exception, or a temporary-use certificate while the house is under construction.

How far from a state highway does a pole barn have to sit?

In the AC, CP, WRC, TC, RC and RR districts, buildings need 150 feet from the county’s arterial highways (Routes 33, 50, 322, 328, 331, 333 and 404) and 100 feet from other state highways. Elsewhere the highway setback is 50 feet.

How tall can an accessory building be in Talbot County?

Residential accessory buildings can reach 25 feet on lots of 2 acres or less and 30 feet on larger lots, and farm buildings 40 feet. A storage building of 300 sq ft or less and no more than 20 feet tall can use half the usual side and rear setbacks.

Can a Talbot County barn host farm tours or events?

Talbot is one of the counties where Maryland’s building standards don’t apply to building or altering a farm building meant for agritourism as a secondary use. An existing farm building used that way isn’t treated as a change of occupancy within set limits, generally 50 people. We check how that fits your plans first.
