Building in Seaford.
Seaford sits on the Nanticoke River, served by US 13 and DE 20. The Nanticoke River Walk, the Seaford Museum and the Ross Mansion and Plantation, the Gov. William H. H. Ross House, are among its landmarks. Inside the city, a garage or workshop has to fit its zoning district’s setbacks and height limit, and the City’s code is tighter than the model code on small buildings.
Just outside city limits, Sussex County handles permits, zoning and inspections, so the first thing we check is which side of the line your property is on. Then we draw the building to the rules that apply, file the permits and build it. Seaford is about 38 miles from our Dover office, roughly 53 minutes by car.

Permits and rules in Seaford.
Inside city limits, the City of Seaford Code Department at 414 High Street, (302) 629-9173, reviews and issues building permits and enforces the City’s zoning ordinance and adopted building codes. Seaford is not one of the towns where Sussex County does plan review and inspections; the City’s inspections are listed on your permit, and the contractor schedules them. The County still requires its own permit for accessory structures inside municipalities, so you need both.
Seaford’s amendments delete the usual building-code exemption for one-story detached accessory structures up to 200 square feet, so even a garden shed needs a permit, and the Building Official may issue a permit only for a structure built of new materials and equipment. In the R-1 district, accessory buildings need 5-foot side and rear setbacks and may sit no closer to the front lot line than the house’s front setback or front wall, whichever is greater.

What people build around Seaford.
On a city lot, a detached garage or workshop behind the house is the natural fit. For commercial and industrial buildings, Seaford’s zoning requires approved masonry on at least 30% of any wall facing a street or interior road, with steel or aluminum allowed on the rest, and that includes their accessory buildings. Sussex County produced 68% of Delaware’s farm sales in 2022, and outside the city line, rural parcels suit equipment buildings, farm shops and horse barns.
Seaford questions.
Have a question about your property? Call 302-399-4420 and we’ll look it up.
Does a small shed need a permit in Seaford?
Yes. The Code Department says permits are required for garden sheds, decks, pools, siding, fences, sidewalks and paving, because Seaford removed the usual exemption for small detached buildings. Sussex County requires a permit for accessory structures as well.
Are Seaford properties along the Nanticoke in a flood zone?
Few of them are, according to the City, and its Building Official serves as Floodplain Coordinator. In the flood overlay, an accessory building of 200 square feet or less can skip raising or floodproofing only if it is used for parking or limited storage, flood-resistant, anchored and fitted with flood openings.
Can a barn go taller than Seaford’s 35-foot limit?
In the R-1 district, the general building height limit is 35 feet or 3 stories, and Seaford’s zoning code exempts barns and silos from its height limits. Other buildings are held to the limit for their district, and we confirm the numbers with the Code Department before drawing.
