Building in Lewes.

Lewes was the site of Delaware’s first European settlement, the Dutch Zwaanendael colony of 1631, and the Zwaanendael Museum keeps that story in town. The City calls itself “The First Town in the First State.” It sits on the Delaware Bay, home to the Cape May-Lewes Ferry terminal, with Cape Henlopen State Park right next door.

Building here is a careful job: lots near the bay can sit in mapped flood zones, the historic district has its own commission, and the City caps the size and use of accessory buildings. We work through each of those before the drawings are final, then build and keep you posted. It takes about 61 minutes to reach Lewes from our Dover office, some 41 miles away.

Permits and rules in Lewes.

The City of Lewes Building Department at 114 E. Third Street, 302-645-7777, does the plan review, issues the City building permit and inspects the work on site; every City permit requires City inspection. Construction must meet the ICC 2021 codes, and since October 12, 2021 all new residential construction needs a fire suppression system. Lewes is not one of the towns where Sussex County does plan review and inspections, but the County still requires its own building permit for all construction, inside a municipality or not.

Accessory buildings may not exceed 900 square feet on the first floor, and unless the building is an accessory dwelling unit it may not have cooking, bathing or sleeping facilities, though one sink and one toilet are allowed. Where a property’s zoning carries an (H), work that alters an exterior facade visible from the public right of way needs approval from the Historic Preservation Architectural Review Commission. Height and setback limits vary by zone, so we confirm them with the City before drawing.

What people build around Lewes.

With the bay and Cape Henlopen State Park at hand, storage for kayaks, bikes and beach gear makes sense here, along with a detached garage or a pool house with one sink and one toilet but no kitchen, shower or bedroom. The 900-square-foot first-floor cap keeps accessory buildings modest, and post-frame construction can leave that floor open from wall to wall.

Lewes questions.

Have a question about your property? Call 302-399-4420 and we’ll look it up.

Do I need a Sussex County permit if the City of Lewes issues one?

Yes. The City of Lewes Building Department reviews the plans, issues the City permit and does the inspections, but Sussex County requires a county building permit for all construction, in a municipality or not. We file both.

What does the Lewes freeboard ordinance require?

For residential structures in the 1% annual-chance flood zone, Ordinance 15-23 (approved May 13, 2024) adds 18 inches of freeboard, for 36 inches in total, and it set an 18-inch requirement for the 0.2% zone starting May 13, 2026. We check your lot against the flood map before we draw.

Can I build near Lewes Beach?

Lewes Beach fronts the Delaware Bay, where DNREC’s coastal building line applies. Building seaward of that line needs a DNREC permit or letter of approval, and work landward of it on a beach needs a DNREC letter of approval, in addition to the City and County permits.

How far is Lewes from your Dover office?
